Terms and Conditions

Please read the following Terms and Conditions carefully. You will be required to sign the declaration on your enrolment, which means you are accepting these terms and conditions.

Fees

Confirmation of enrolment and a fees invoice will be sent to your email. Payment of all fees are due prior to the programme of study/course start date.

If you are applying for a learner loan through StudyLink, we expect you to complete your application as soon as possible and no later than the programme of study/course start date.

Learners who wish to dispute the fees or request a review of fees or account balance must do so within seven (7) working days of receiving the invoice. Any requests must be made in writing to the registry office.

At the discretion of Future Skills Academy, and with just cause, this period may be extended. Once the request is received, the review will be completed within seven (7) working days. Once the review is completed, any outstanding balance is due immediately.

Failure to pay any invoice(s) by the due date means you will then be liable for all costs and expenses incurred in the recovery, or attempted recovery of the overdue amount from you.

This includes legal costs and debt collection agent fees, which may affect your credit rating.

Under these circumstances Future Skills Academy may give to, or obtain from, any relevant third-party, information held about your personal or commercial credit.

Academic results for any programme of study or course(s) will be withheld where fees or any other debt remains unpaid. You will be prevented from graduating or receiving your award(s) until your debt has been paid in full. You will also be prevented from re-enrolling in further programmes of study or courses at Future Skills Academy.

 

Transfer to another programme of study or course

Transfers are negotiated with the Head of Department or Programme Leader.  There are no penalties; however, there may be additional fees required or a refund may be due.  Where a learner loan has been used to pay fees, the refund will need to be returned to StudyLink and a new loan drawn down for the new programme.

 

Withdrawal and/or refunds

The key points of Future Skills Academy’s refund policy, Withdrawal, Transfer, Cancellation and Refund Policy are summarised below.

If you have any questions, contact the registry office. Make sure you understand the refund policy before enrolling.

If you wish to leave your programme of study or course, you must formally withdraw. This means you must notify Future Skills Academy in writing by emailing:

Verbal notice of withdrawal will not be accepted as a learner’s intention to withdraw. The withdrawal date from a programme is taken as the date the email is lodged. This will then be used when processing your withdrawal in the Learner Management System (SMS).

Please take a note of the “early withdrawal period”, the period you can withdraw by and be able to receive a refund, less admin fees.

Compassionate consideration

If you withdraw after the last date for a withdrawal with a refund date has passed you may be eligible to apply for compassionate consideration. Compassionate consideration may be considered for the following reasons:

  • Health and wellbeing, supported in writing by a health professional.
  • Other unanticipated circumstances beyond your control.

Future Skills Academy will advise the result of the application for compassionate consideration.

 

Non-attendance

If you have more than four consecutive weeks of non-attendance in classes, or non-participation in required online activities associated with your programme, and we are unable to contact you, you will be withdrawn from the programme.

 

Public Trust

As part of the enrolment process, you will receive a Public Trust Fee Protection Contract. By law, private training establishments registered with the New Zealand Qualifications Authority (NZQA) are required to have some form of protection for fees paid to them in advance. Future Skills Academy has chosen Public Trust.

 

Public Trust – Fee Protect

Fee Protect is a learner fee trust account which ensures you receive a refund on learner fees, which are held in trust, in the unlikely event, Future Skills Academy is unable to complete your programme of study. This could be because of closure, insolvency, loss of NZQA accreditation or programme within the stated timeframe.You are required to initial, sign, and return the Public Trust Contract to Future Skills Academy within seven days of its receipt. Enrolment in a programme of study or course is conditional upon and subject to enough learners enrolling in the programme of study or course.

Future Skills Academy collects and stores information about learners to comply with various statutes and/or regulations, to enable us to make decisions regarding your academic progress, and to provide you with evidence of your academic achievements to:

  • manage the business of Future Skills (including internal reporting, administrative processes and selection of scholarship and prize winners).
  • comply with the requirements of the Education Act 1989 and other legislations relating to maintenance of records.
  • supply information to government agencies and other organisations as set out below.

In signing the enrolment form you authorise such disclosure on the understanding that Future Skills will observe the conditions governing the release of information, as set out in the Privacy Act 1993, the Education Act 1989 and other relevant legislation.

NB: The Privacy Act came into force on 1 July 1993 with the stated aim of protecting the privacy of natural persons. It requires Future Skills to collect, hold, handle, use and disclose personal information in accordance with the twelve information privacy principals in the Act. http://www.privacy.org.nz/privacy-act.

 

Supply of information to government agencies and other organisations

Future Skills supplies data collected from you to government agencies, including:

  • the Ministry of Education.
  • the New Zealand Qualifications Authority.
  • the Tertiary Education Commission.
  • Immigration New Zealand
  • the Ministry of Social Development (in relation to learner loans and allowances) and Inland Revenue (learner loans).
  • agencies who support particular learners through scholarships, payment of fees or other awards (if you are a recipient of one of these awards).

These agencies use the data collected from tertiary education organisations to:

  • administer the tertiary education system, including allocating funding.
  • develop policy advice for government.
  • conduct statistical analysis and research.

Your personal details (name, date of birth and residency) as entered on the form will be included in the National Learner Index and may be used in an authorised information matching programme with the New Zealand Birth Register.

The government agencies above may supply data collected on the form to Statistics New Zealand for the purposes of integrating data with data collected by other government agencies, subject to the provisions of the Statistics Act 1975. Integrated data is used for the production of official statistics, to inform policy advice to government and for research purposes. In handling data supplied by you on this form, the government agencies are required to comply with the provisions of the Privacy Act 1993.

When required by law, Future Skills releases information to government agencies such as the New Zealand Police, Department of Justice, Ministry of Social Development, and the Accident Compensation Corporation (ACC). Information collected from you may be supplied to other educational organisations for the purpose of verifying academic records.

You must attend classes consistently and come to class on time. Your class timetable will be available on Your Space closer to your programme start date. If you are unable to attend class, or if you will be late to class, you must advise your lecturer or the Student Success department.

International Learners must have a 100% attendance in all their scheduled classes unless there is a genuine and valid reason otherwise. Failure to attend without a doctor's certificate or valid reason may result in the termination of the learner's enrolment as outlined by Immigration New Zealand.

You must provide your current address and contact phone numbers. If you change your address or your phone number, you must immediately email the Registry office:

  • Learners are reminded that no learner can expect exclusive use of any one computer.
  • You are not allowed to view or download pornographic images on the computers owned by Future Skills.
  • Any learner who uses email or texting to harass, intimidate or abuse another learner, staff member or member of the public may face immediate dismissal.
  • You are responsible for the protection of your password. This means not giving your password to any other learner.
  • You must not load or download any programmes on to a computer without the permission of your lecturer.
  • You must not download, copy or use any offensive images or images depicting drugs, or violence.
  • Please turn off your mobile phones during class unless agreed by your lecturer.

If you wish to make a complaint, you should first talk to your Lecturer about your concern especially if it is concerning assessment results, course delivery or any student behaviour that concerns you, for example bullying. If you feel uncomfortable talking to your Lecturer, you can speak to any other member of staff or the Academic Director.

If you wish to make a formal complaint, you can either put this in writing and give it to Reception addressed to the Academic Director, send an email to the Academic Director, or make a request to speak directly to the Academic Director. The urgency of the issue will be assessed and a time frame for resolving your complaint given to you. We will then report back to you within the agreed timeframe, with a resolution proposal or action.

If you are not satisfied you may put this in writing to the CEO and give it to Reception, send an email to studentsuccess@futureskills.co.nz addressed to the CEO or make a request to speak directly to the CEO.

If you are still dissatisfied you can make a complaint to the New Zealand Qualifications Authority http://www.nzqa.govt.nz/about-us/make-a-complaint/make-a-complaint-about-a-provider/ or phone 0800 697 296.

You will need to successfully complete all of the assessments, to gain the qualification.  Assessments can be written, oral, practical, group or project based.

Once your assessments have been marked the lecturer will advise you of your result. You have the right to view your marked assessment papers.  All assessment documentation is retained by Future Skills Academy.

If you do not successfully achieve in an assessment, you may do a re-assessment.

If you think that your assessment result is unfair, discuss this with your respective Head of Department.  If you cannot reach an agreement with your Head of Department, you can request for the assessment to be re-marked by a second assessor.

When completing assessments, you must do your own original work. Copying from other learners is not allowed. Your lecturer will guide you regarding the conditions for each assessment. This will also be elaborated on in your course handbook.

The disciplinary procedures are provided for the protection of students and staff.

 

Misconduct

If you do not comply with the rules, you will be asked to come to an interview and will be given a written warning notice.  If you have already received two (2) written warnings and still do not comply with the rules, you may be dismissed.

 

Serious Misconduct

If you do not comply with the rules, and you put yourself or others at risk, you may be immediately suspended or immediately dismissed.  If you are aged under 18, your parent or caregiver will be informed and asked to attend a meeting with you at Future Skills prior to any dismissal. 

Breaches of the Academy’s rules, regulations, policies, and standards includes but are not limited to:

  • Providing false information on application(s)
  • Cheating including plagiarism
  • Inappropriate or unacceptable behaviour that interferes with the rights and safety of other people
  • Bringing the name of the Academy into disrepute
  • Use of offensive language, imagery, or gestures (verbal, written or electronic)
  • Steals, damages or abuses any property belonging to the Academy
  • Threatening, bullying, harassing or intimidating behaviour
  • Carrying or being under the influence of drugs and/or alcohol without a medical prescription
  • Acts of aggression
  • Criminal behaviour that is likely to result in police or legal investigation
  • Bringing onto the premises a firearm, dangerous weapon and or explosive
  • Offering bribes
  • Inappropriate use of Future Skills Academy’s property, computers, networks, including unauthorised access to IT systems or IT services, cyber-bullying in any form on any platform (whether done on or off Academy premises or networks).
  • Using the Academy’s supplied networks to view inappropriate material (whether Academy owned computers, or on personal computers or personal devices); and
  • Failing to comply with any lawful instruction by the organisation.
